Florida Lawmaker Proposes Street Smoking Ban While Supporting Marijuana Legalization

In a recent virtual news conference, Florida State Senator Joe Gruters announced a proposed bill aimed at prohibiting smoking and vaping in public spaces, coinciding with the potential legalization of marijuana through Amendment 3. Gruters, who supports the amendment, emphasized the need for such legislation to enhance environmental quality and public enjoyment, stating that smoking infringes on the comfort of individuals in public areas. The proposed legislation would ban smoking in all public spaces, including streets, sidewalks, and parks, effective July 1, should Amendment 3 pass. Currently, Florida has restrictions on indoor smoking, and local governments can regulate smoking in their parks and beaches. Gruters expressed concern over the public perception of smoking, referencing cities like Las Vegas and New York, where street smoking has become prevalent and often unwelcome. Gruters, a former chair of the Republican Party of Florida, views this bill as a foundational step in creating regulations to protect the public if marijuana is legalized. The legislation would encompass a wide range of public areas, including schools, hospitals, and restaurants, aiming to create a smoke-free environment for all Floridians. This initiative places Gruters at odds with Florida Governor Ron DeSantis, who has publicly opposed Amendment 3, citing negative experiences in other states where similar measures have been implemented. DeSantis has expressed concerns about the potential for marijuana odors to permeate public spaces, highlighting the ongoing debate surrounding marijuana legalization in Florida.
