However, Judge Immergut determined that the plaintiffs did not sufficiently demonstrate that Adidas made materially misleading statements in its public disclosures. The court's decision focused on Adidas's risk disclosures related to potential misconduct by business partners, which the judge noted did not imply that such behavior had not occurred. Instead, the disclosures acknowledged the possibility of "improper behavior" and warned of its potential negative impact on the company's reputation. Furthermore, the judge rejected claims that Adidas's diversity, equity, and inclusion (DEI) statements were misleading, characterizing them as aspirational rather than concrete commitments under federal securities laws.
