His lawyer, Arthur Aidala, confirmed that Weinstein will attend the arraignment in person after recovering from emergency heart surgery. The new charges stem from allegations of assaults that occurred in the mid-2000s at the Tribeca Grand Hotel and a Lower Manhattan residential building, as well as an incident in May 2016 at a Tribeca hotel. The Manhattan District Attorney's office revealed that a grand jury had returned the indictment, which remains sealed until the arraignment. Prosecutors intend to incorporate these new charges into Weinstein's retrial for his previous conviction, which was overturned earlier this year by New York's highest court. The retrial is scheduled to begin on November 12. Weinstein's legal team opposes the inclusion of the new charges in the retrial, arguing that they should be treated as a separate case. Aidala expressed uncertainty about the specifics of the new allegations, including the exact accusations and their timing, due to the sealed nature of the indictment. Weinstein, who has consistently claimed that any sexual encounters were consensual, has been receiving medical treatment at Bellevue Hospital following surgery to address fluid accumulation around his heart and lungs.
