The court's ruling came after Lidl demonstrated that local pub offerings were inadequate, owing to the closure of two pubs in the area. The supermarket plans to invest at least £410,000 into the new establishment, which will include a seating capacity for around 45 customers and an off-licence area for selling alcohol products available in Lidl stores. The initial planning permission was granted for the pub back in August 2020; however, it faced objections from Philip Russell Ltd, which contended that Lidl had not sufficiently proven the need for a new licensed premise in the vicinity, as stipulated by the Licensing (Northern Ireland) Order 1996. According to this regulation, new alcohol sale licenses can only be issued if existing ones are surrendered. Russell's appeal was based on the assertion that there were adequate licensed establishments nearby to meet the demand. In his judgment, Mr. Justice Colton recognized Lidl’s efforts in establishing the insufficiency of licensed premises in Dundonald. He noted that if the pub application is approved, there would be only one licensed bar remaining in a vicinity where two pubs once thrived. The judge stated that the pub's location, near transport links and in a developing area with a growing adult demographic, would benefit the community. He emphasized that Lidl's intentions are sincere and that the supermarket is committed to operating the pub lawfully.
