Burke Law Group rejects $150 million contract to represent migrant children

In McAllen, Texas, a small law firm known as Burke Law Group, which has connections to the Trump administration, recently declined a significant contract worth $150 million to represent unaccompanied migrant children who have traveled alone to the United States. This decision was made public by authorities on a Wednesday, following the expiration of a key contract with nearly 100 providers through the Acacia Center for Justice. The contract was initially offered to Burke Law Group after the previous arrangement expired, leaving many children in federal custody without adequate legal representation. The agency responsible for the contract, part of the Department of Health and Human Services, confirmed that Burke Law Group had not applied for the grant and did not provide a reason for their decision. The founder of Burke Law Group, Marcella Burke, previously served in the Trump administration as a lawyer for the Environmental Protection Agency and the Department of the Interior. The situation for unaccompanied migrant children remains precarious, as they are often placed in federal care after entering the U.S. without their parents. Currently, about 1,800 children are living in shelters, while approximately 22,000 are facing deportation and are living with outside sponsors, such as family members. The legal service providers whose contracts expired have been advocating for these vulnerable children, but the future of their representation is uncertain as their contracts are set to expire in December. In a related development, the administration awarded a separate contract worth up to $244 million to Our Rescue, an anti-child-trafficking organization that gained notoriety from the 2023 film 'Sound of Freedom.' This organization, previously known as Operation Underground Railroad, has faced scrutiny due to allegations of misconduct against its founder, Tim Ballard, who resigned in 2023. Derek Benner, the current CEO of Our Rescue, expressed his commitment to advocating for the children, emphasizing their vulnerability and the need for experienced representation. The legal landscape for these children is further complicated by the recent actions of the U.S. Committee for Refugees and Immigrants, which received a temporary contract for $20 million to provide legal aid until the end of the year. However, confusion arose when attorneys from this group began appearing in immigration court without prior notice, claiming to represent children they had not yet met. This has led to complications and confusion among judges and lawyers still involved with the expired contract. Additionally, some legal aid providers whose contracts expired have taken legal action against the administration for unpaid services, resulting in a federal judge ordering the government to compensate these providers.
